    • What types of properties that an NRI can buy in India?
      • An NRI/PIO can buy: residential or Commercial Properties
      • An NRI/PIO cannot buy: Agricultural lands/Farmhouse
    • Do an NRI need any RBI approval to buy immovable property in India?

      No. No permission are required to an NRI to buy residential/commercial lands in India.

    • Is there any limitation to NRI to purchase immovable properties in India?

      No. There are no restrictions or limitations applicable to NRI for buying residential/commercial lands in India.

    • Can a Foreign citizen hold ownership rights to the property purchased by an NRI?

      No. The land/plot purchased by an NRI can either be purchased in a single name or jointly with any other NRI.

    • How to finance the property that you purchased in India?
      • Through foreign banking channels
      • Through FCNR account
      • Through NRE/NRO Account

      Foreign currency or payment made by the traveler's cheque is not to be allowed to pay for a property that an NRI/PIO purchased in India.

    • Can a foreign citizen who reside outside India can purchase property in India?

      No. A non-Indian origin who is residing outside India cannot purchase properties in India. But, citizens of certain countries can acquire immovable properties in India on lease from a person who is a resident in India for five years without taking RBI permissions.

    • Can a NRI get commercial/residential property in India as gift?

      Yes. NRIs/PIOs can acquire properties other than agricultural land/farmhouse/plantation by the way of gift from another NRI or PIO or an Indian resident.

    • Can a NRI sell or transfer his/her immovable property in India?

      Yes. An NRI can sell his/her properties in India to:

      • A person who is resident in India
      • An NRI or a PIO
    • Can a NRI/PIO avail loan in rupees to buy property in India?

      Yes, they can avail loans from authorized banks under specific terms and conditions. As of RBI's Foreign Exchange Management (Borrowing and lending in rupees) Regulations, 2000, the banks/authorized financial institutions can lend money/loan to the NRIs in rupees for the purpose of immovable land purchase/renovation of residential properties owned by them in India.
